Shark Harbor Giveback Program — Terms & Conditions
Effective Date: October 11, 2026
1. Program Overview
The Shark Harbor Giveback Program supports eligible schools and school-affiliated nonprofit organizations through purchases made at sharkharbor.shop.
Approved participating organizations may earn a contribution equal up to 10% of qualifying merchandise sales attributed to their unique referral link.
The contribution is paid by Shark Harbor LLC to the participating organization. It is not a discount to the customer, and customers are not charged an additional fee to participate.
2. Eligibility
Participation is available to approved schools, Parent Teacher Organizations (PTOs), Parent Teacher Associations (PTAs), school foundations, and school-affiliated booster organizations.
Applicants must provide:
-
Their legal organization name and contact information.
-
A valid Employer Identification Number (EIN).
-
A copy of their IRS 501(c) determination letter.
-
Any additional information reasonably requested to verify eligibility.
Submission of an application does not guarantee acceptance. Shark Harbor reserves the right to approve or decline applications at its discretion, consistent with applicable law.
3. Enrollment and Approval
Organizations must complete the official Shark Harbor Partner Application and receive approval before participating.
Once approved, each organization will receive a unique referral link to share with its supporters.
Participation is not transferable without Shark Harbor's written consent.
4. Qualifying Purchases
Approved organizations earn a contribution equal up to 10% of qualifying merchandise sales attributed to their unique referral link.
To qualify, purchases must be completed at sharkharbor.shop using the participating organization's referral link.
The Shark Harbor Giveback Program cannot be combined with discounts, promotional codes, coupons, or other special offers. Purchases made using a discount or promotional offer are not eligible for Giveback contributions.
Qualifying sales exclude:
-
Sales tax.
-
Shipping and delivery charges.
-
Refunded, returned, or canceled merchandise.
-
Breast cancer fundraising merchandise and other designated charitable fundraising products.
-
Products or collections specifically excluded from the program.
-
Gift card purchases.
Only qualifying purchases successfully attributed to an approved organization's referral link will earn a contribution. Retroactive credit is not guaranteed.
5. Refunds, Returns, and Adjustments
Contributions are calculated on eligible sales retained after refunds, returns, cancellations, and applicable adjustments.
If a qualifying purchase is partially or fully refunded, the corresponding contribution will be reduced.
If an adjustment occurs after a contribution has already been paid, the adjustment may be applied against future amounts owed to the organization.
6. Contribution Tracking
Shark Harbor uses a third-party referral tracking platform to attribute qualifying purchases to participating organizations.
Referral tracking may depend on browser settings, cookies, and other technical factors. Shark Harbor cannot guarantee attribution when referral tracking is blocked, disabled, interrupted, or otherwise unsuccessful.
Shark Harbor's transaction and referral records will be used to determine program contributions, subject to correction of verified errors.
7. Contribution Payments
Contributions will be reviewed and calculated quarterly.
Payments will be issued after eligible transactions have been reviewed for refunds, cancellations, and other adjustments.
Shark Harbor may request updated payment or organizational information before issuing a payment.
Any applicable minimum payout threshold, if established, will be communicated to participating organizations before it takes effect. Amounts below such a threshold will carry forward to a subsequent payment period.
8. Organization Responsibilities
Participating organizations agree to:
-
Share their assigned referral link accurately and responsibly.
-
Avoid misleading statements regarding the program or potential contributions.
-
Refrain from representing themselves as employees or legal agents of Shark Harbor.
-
Use contributions for lawful organizational purposes.
-
Notify Shark Harbor of changes to their eligibility, nonprofit status, contact information, or payment information.
Organizations may not engage in fraudulent purchases, artificial referral activity, or other attempts to manipulate contribution tracking.
9. Marketing and Brand Use
Participating organizations may identify themselves as approved Shark Harbor Giveback Program partners.
Use of Shark Harbor's logos, trademarks, artwork, or other brand materials requires prior authorization unless Shark Harbor has expressly provided those materials for partner use.
Participation does not constitute an exclusive partnership, sponsorship, or endorsement of an organization's activities.
10. Program Changes and Termination
Shark Harbor reserves the right to modify, suspend, or discontinue the program, including its eligibility requirements, qualifying products, and contribution structure.
Material changes will be communicated to participating organizations when reasonably practicable.
Shark Harbor may suspend or terminate an organization's participation for fraud, misuse, misrepresentation, loss of eligibility, or violation of these terms.
Termination does not automatically eliminate valid, previously earned contributions, which remain subject to applicable adjustments and these terms.
11. Tax and Legal Responsibilities
Participating organizations are responsible for determining the appropriate accounting, reporting, and tax treatment of contributions received.
Shark Harbor does not provide tax or legal advice to participating organizations.
Participation does not create an employment, agency, joint venture, or partnership relationship between Shark Harbor and the organization.
